Former Cabinet Secretary Raphael Tuju has secured a major legal reprieve after the High Court granted him a KSh200,000 anticipatory bond, effectively barring police from arresting or detaining him as investigations continue.
The ruling, issued by Justice Martin Muya, comes in the wake of a fast-escalating standoff between Tuju and state agencies, following his claims of harassment and threats to his personal safety.
In his urgent court application, Tuju argued that he had been under constant surveillance and intimidation by security agencies, including being trailed by unmarked vehicles. He recounted a dramatic incident on March 21 in which he was allegedly forced to abandon his vehicle and seek refuge at a secure location.
He further claimed that upon reporting the matter at Karen Police Station, he was manhandled by officers—an incident he says worsened injuries sustained in previous accidents.
Through his legal team, Tuju sought court orders to restrain the National Police Service, the Directorate of Criminal Investigations, and the Office of the Director of Public Prosecutions from arresting, summoning, or interfering with his movement—particularly as he continues to receive medical treatment.
Justice Muya certified the matter as urgent and granted the anticipatory bond, a legal safeguard designed to protect individuals from imminent arrest. The order temporarily halts police action against Tuju pending further court directions.
The case is scheduled for mention on April 7, 2026, where the court will give further directions on the matter.
The High Court intervention comes as Tuju faces a separate criminal case, where he is accused of providing false information to a public officer—stemming from claims that he had been abducted, which prosecutors allege were fabricated.
The charges have added a new layer of complexity to an already high-profile saga that has drawn national attention, raising questions about the conduct of law enforcement agencies and the rights of individuals under investigation.
