Nairobi Lawyer Kepher Ojijo has filed a motion with the Law Society of Kenya to strike out Professor Kithure Kindiki and Onesmus Kipchumba Murkomen from the Roll of Advocates.
The petitioner claims the duo allegedly violated the code of conduct of advocates by being complicit to State-sponsored violence.
Ojijo alleges that during their tenure and under their policy directives, the country has witnessed an unprecedented wave of police brutality.
Ojijo further claims that rather than demonstrate remorse or accountability, the two leaders have continued to publicly justify these actions, which he says demeans the legal profession and renders them unfit to practice as advocates of the High Court of Kenya.
“The respondents continue to identify as advocates while overseeing state-sanctioned brutality,” the motion reads in part. “This misleads the public and demeans the integrity of the legal profession.”

The petition roundly faults the duo for failing to take responsibility or express remorse, accusing them instead of praising the conduct of law enforcement despite mounting evidence of human rights violations.
Ojijo is calling for an urgent Special General Meeting of LSK members to vote on whether to strike the two from the Roll of Advocates. In the alternative, he proposes that the matter be referred to the Advocates Disciplinary Tribunal.
“If the respondents wish to engage in politics, they should do so without wearing the hat of advocates,” he argues.
The motion comes amid growing public anger over the state’s handling of youth-led protests. Rights groups have accused the government of deploying excessive force and targeting peaceful demonstrators.
