ODM Legal Storm Deepens as Tribunal Greenlights Sifuna Case

The Orange Democratic Movement (ODM) has suffered a significant legal setback after the Political Parties Disputes Tribunal (PPDT) ruled that it has jurisdiction to hear a complaint filed by the party’s Secretary General, Edwin Sifuna.

In a decisive ruling, the Tribunal dismissed a preliminary objection that sought to block the proceedings, effectively clearing the path for the high-stakes dispute to proceed to a full hearing. The objection had challenged the Tribunal’s authority to entertain the matter, but the panel firmly rejected that argument, affirming its mandate to adjudicate the case.

The decision marks a critical turning point in the simmering internal wrangles within ODM, as it opens the door for a substantive examination of the issues raised by Sifuna against his own party.

However, the Tribunal stopped short of issuing conservatory orders at this stage. It noted that granting such orders would be premature before the core issues in dispute are fully interrogated and determined.

In a further directive, the PPDT clarified that any outcome arising from an Alternative Dispute Resolution Mechanism (ADRM) process between Sifuna and ODM will remain in abeyance until the Tribunal conclusively hears and determines the case. This effectively freezes any parallel settlement efforts from taking effect in the interim.

The ruling now sets the stage for what promises to be a closely watched legal battle, with far-reaching implications for party cohesion, leadership dynamics, and the broader political landscape. As the case proceeds to full hearing, attention will turn to how ODM navigates the escalating internal tensions—and whether reconciliation remains within reach.
