“Arm Yourselves” Post Lands Man in Court: DCI Arraigns X User Over Incitement Claims

A man has been charged at the Milimani Law Courts for publishing false and inflammatory information online, in a case that underscores the government’s hard line on digital incitement and misuse of social media.

Detectives from the Special Crime Unit (SCU) on Monday arraigned Boniface Mulinge Muteti over allegations that he disseminated false information through his X (formerly Twitter) account, with intent to incite violence and public disorder.

According to court documents, on December 6, 2025, Muteti—using the username Mulinge Muteti—posted a highly provocative message urging members of the public to seize property allegedly owned by politicians. The post claimed that politicians had never legitimately worked, innovated or invented anything, and alleged that all their wealth had been stolen from Kenyans. It went further to call on the public to “arm yourselves and prepare for the coming uprising.”

Investigators say Muteti published the message knowing it to be false and with the intention of inciting violence, an offence under Section 23 of the Computer Misuse and Cybercrime Act No. 5 of 2018, which criminalises the publication of false information likely to cause panic, chaos or violence.

When he appeared before the Milimani Law Courts, Muteti pleaded not guilty to the charges. The court granted him bail of Sh15,000, pending the hearing and determination of the case.

The matter is scheduled for a pretrial hearing on December 30, 2025.

In a statement following the arraignment, the Directorate of Criminal Investigations (DCI) reiterated that spreading false or misleading information online is a criminal offence, warning that social media platforms must not be used to incite violence or undermine public order.

“The DCI urges all Kenyans to exercise restraint, responsibility and caution in their use of digital platforms,” the agency said, adding that online speech carries legal consequences just like offline conduct.

The case adds to a growing list of prosecutions under Kenya’s cybercrime laws, as authorities intensify surveillance and enforcement amid rising concerns over online incitement and misinformation.
